T&C's

  1. Relationship and Responsibilities

    1. It is expressly understood that the Client retains the services of the Carer as an Independent Contractor and not as an employee.

    2. The Carer undertakes to perform the agreed-on services in an attentive, reliable and caring manner and the Client undertakes to provide all necessary information to assist in this performance.

    3. The Carer undertakes to notify the Client of any occurrence pertaining to the pet which may be relevant to the care and well-being of the pet.

    4. The Carer will supply and be equipped with waste bags and will duly remove pet faeces from all public places.

    5. The Carer reserves the right to walk other compatible dogs at the same time for group slots but undertakes to limit the number of dogs walked with one person to 4 (four). This does not apply for agreed solo dog walking slots.

    6. The Carer may need to bring other dogs to The Clients residence when picking up their dog. The Carer will ensure no damage is caused by other dogs and will compensate for such occurrences. Any fowling by other dogs will be dealt with immediately. Furthermore, the Carer will ensure this process to be smooth and endeavour to carry out pick ups and drop offs as stress free as possible. Dogs that do not know each other will need to meet prior to first walk together.

    7. The Client is responsible and will ensure that their pet is up-to-date with their vaccinations, flea and tick treatments and de-wormer treatments. If the Carer deems the pet to be showing signs of parasites or other infectious condition, The Carer has the right to cancel walks until the issue has been resolved.

    8. Booked slots are estimated only. The Carer will make every effort to arrive at the time requested, however, The Client should allow approximately 30 minutes after the booked time slot for The Carer to attend.

    9. Please note that time starts from when The Carer arrives at The Clients property. If The Client has made further requests to The Carer, this will take extra time out of booked dog walks. All actual walks are approximately 25 minutes or 50 minutes long. 

    10. The Client will provide suitable harnesses, collars and leads as approved by the Carer as well as coats or muzzles if required.

    11. The Carer shall not be obliged to perform any other duties except those specified on the Pet Information sheet/Online form

    12. The Carer is insured through Protectivity. Wherever possible pets should be insured by the client.

    13. The Client consents to their pet being photographed, videotaped, and/or used in any media or advertising.

  2. Compensation

    1. The Carer shall be paid the sum for which will be owed according to the price list. This is paid per week.

    2. Prices are subject to changes depending on circumstances and inflation.

    3. Payment will be invoiced at the end of each week by the Carer and is due by the following Monday.

    4. If payment is not received by the due date this will roll over to the following week and may include a late payment fee. Over two weeks late and The Carer has the right to stop services until payment is received.

  3. Duration

    1. Services requested shall come into effect on the agreed date and shall: A. Terminate on specified date OR B. Terminate when either party gives 7 (seven) days written notice of termination.

  4.  Cancellation or Early Termination

    1. Either party may terminate Services a minimum of 24 (twenty four) hours prior to the first scheduled visit without incurring penalties or damages.

    2. Cancellation by the Client of scheduled services with less than 24 hrs notice may be charged at the full rate or rescheduled at the discretion of the Carer.

    3. Where the Carer as sole proprietor needs to cancel a scheduled service due to unforeseen circumstances, he/she may appoint a substitute Carer with the written approval of the Owner and any difference in the fees charged will be at the discretion of the cover Carer.

    4. If, due to unforeseen circumstances, The Client is given less then 24hrs notice of cancellation from The Carer and is unable to find cover, The Carer will not charge for the service and will add a discount to the following week for the inconvenience caused.

    5. Should any pet become aggressive or a danger (i.e. dog shows signs of contagious infections, bitch in season, etc), the Carer may temporary or permanently terminate services with immediate effect for the safety of other pets and the public.

    6. Any wrongful or misleading information in the Pet Information sheets/online forms may constitute a breach of terms and conditions, and be grounds for instant termination thereof.

    7. Termination under the circumstances described in 4.4 or 4.5 above shall not entitle the Client to any refunds nor relief of any outstanding payments due.

  5.  Liability

    1. The Carer accepts no liability for any breach of security or loss of or damage to the Client's property if any other person has access to the property during the term of this agreement.

    2. The Carer shall not be liable for any mishap of whatsoever nature which may befall a pet or caused by a pet who has unsupervised access to the outdoors.

    3. The Client shall be liable for all expenses and damages resulting from an injury to the Carer caused by the pet as well as damage to the Client's property.

    4. The Carer is released from all liability related to transporting pet(s) to and from any veterinary clinic or kennel, the medical treatment of the pet(s) and the expense thereof.

  6.  Indemnification

    1. The parties agree to indemnify and hold harmless each other and assigns from any and all claims arising from either party's willful or negligent conduct.

  7.  Emergencies

    1. In the event of an emergency, the Carer shall contact the Client at the numbers provided to confirm the Client's choice of action. If the Client cannot be reached timeously, the Carer will contact the Emergency Contact, if one has been provided. If neither Client nor Emergency Contact can be reached, the Carer is authorized to:

      •  Transport the pet(s) to the listed veterinarian;

      • Request on-site treatment from a veterinarian;

      • Transport the pet(s) to an emergency clinic if the previous two options are not feasible.

  8. Security/Privacy Policy

    1. The Carer warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Client and to return same to the Client at completion of booking or immediately upon demand.

    2. All Client information and records will be stored in compliance with GDPR 2018. We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews and recommendations.

    3. When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

    4. We collect such Non-personal and Personal Information for the following purposes:

      • To provide and operate the Services;

      • To provide our Users with ongoing customer assistance;

      • To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

      • To comply with any applicable laws and regulations.

    5. ​Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 
      All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

    6. We may contact you to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

  9. Relaxation of Terms

  1. No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

 10. Whole Agreement

  1. The Terms & Conditions, Pet Information sheet(s)/Online form and off-lead consent form (if applicable) constitute the sole and entire agreement between the parties with regard to the subject matter hereof and the parties waive the right to rely on any alleged expressed or implied provision not contained therein. Any alteration to this agreement must be in writing and agreed by both parties.

 11. Assignment

  1. No party may assign any of its rights or delegate or assign any of its obligations in these Terms and Conditions without the prior written consent of the other party, except where otherwise stated.

 12. Binding Effect

  1. The terms of service shall be binding upon and accrue to the benefit and be enforceable by either party's successors, legal representatives and assigns.

Walking Off-lead Consent

 

  1. Terms & Conditions

    1. Dogs will never be walked off lead without prior discussion and the consent of the Client

    2. Walking off-lead will be dependant upon the reliability of the dog's recall, how they interact with other dogs and their prey / chase drive

    3. Dogs will only be walked off-lead if The Carer deems it safe to do so. It is never a guarantee that the dog will walk off-lead, even if arranged, as it depends on many factors such as weather, location, other dogs at the location, current behaviour of the dog etc

    4. Walking off-lead may only be for a section of the walk, not the full duration

  2. Consent

    1. The Client gives The Carer permission to walk their dog off-lead during any walk undertaken during their absence, during any scheduled walk.

    2. The Client understands the potential consequences that could occur to their dog or other dogs if walking their dog off the lead whilst under the supervision of The Carer. The Client agrees to release The Carer from all liability should their dog become lost, injured or otherwise harmed which may result from their dog being walked off-lead.

    3. The Carer agrees to exercise all reasonable and due care to prevent injury or death to the dog off the lead, however, in the event of injury / death, except those caused by reckless acts on the part of The Carer, The Carer will not be held liable for such injury / death of The Clients dog as a result of off – lead walking.

Informed Consent to Chip

 

When booking microchipping of pets The Owner is giving The Implanter consent to implant a chip into your pet.

The Owner will be told that their records will be held on the Animal Tracker/Petlog database, that they will only be used for the purpose of reunification and for compliance with microchipping of dogs 2015 legislation and that it is The Owner legal responsibility to keep these records up to date.

 

If it is a litter of puppies that are being chipped The Breeder must understand that it is a legal requirement that the puppies are registered in the first instance to The Breeder.

 

To implant a microchip it will be injected under the skin, between the shoulder blades of the animal.

 

The implanter has advised that I must:

  • Leave the actual site alone for at least 12-24 hours, i.e. strictly no scruffing or excess stroking in this area.

  • Try to refrain from vigorous exercise, at least aiming to keep as calm as possible for 4-6 hours after microchipping had been carried out

  • No grooming/bathing

  • No harnesses

  • No clothing

 

I also understand that:

  • The implant area may bleed due to catching a capillary in the skin, if this should happen The Implanter will ensure the bleeding has stopped before they leave, however The Owner/Breeder should not attempt to clean the site for at least 24hours as this could lead to infection.

  • If The Owner/Breeder follows this advice there is very little risk of infection, however if The Owner/Breeder should see swelling at the implant site, they should seek a vet’s advice.

  • Minor migration of the chip may occur depending on the behaviour of the animal/s in the first few hours after implantation.

  • If a Breeder is having a litter microchipped it is highly recommended that The Breeder invests in their own scanner so that they can check all microchips are still in place before the puppies leave for their new keeper and also so that The Breeder can make sure they send the correct paperwork with the correct puppy.
